    We are extremely excited to announce that some other senators we were in touch with, have introduced amendments in favor of legal skilled immigrants. We will reveal details pretty soon.

    Before anyone thinks about posting that the bill is dead, we have some news for you! It is not. There is too much noise right now and the undocumented folks doing rallies with 100K people at one time, this will not be pushed under the rug. Also, we have heard whispers in DC that the immigration bill will be taken up pretty soon after the recess :)

    Your 9 month initial stay will not be counted as you stayed 1 year out of usa.

    So total L1 period is 13 months so far. and Total of l1+h1 is 6 years. so you can have 4 years + 9 months on H1 and your initial H1 will be for 3 years

    The information that is provided in this post is relevant as of Friday May 15, 2009. This is coming from our local AILA chapter Chair.

    As many of our readers know, at the conclusion of the Marriage based adjustment of status interview, the immigration officer, upon approval, used to stamp the immigrant's passport with the I-551 (Green Card) stamp. This used to be an immediate proof that the case was approved and the applicant could work and travel using this stamp. As the actual production of the Green Cards became so fast, the practice of stamping applicants' passports stopped as well in most states across the nation.

    It seems that things are changing, hence the recent notice from USCIS. According to the notice we received, the Green Card Facility in KY is undergoing renovation. USCIS' card production capability will be reduced over the next several months. They will expand the use of ADIT Temporary Green Card stamps as temporary evidence of LPR status.

    The Stamps will be valid for 12 months (previously only 30 days validity was given). Work permits and travel documents (advance paroles) will be collected at the interview from the clients. The stamp will be the only proof of work and travel authorization in such cases. It looks like this policy will continue for the next 6-12 months. This is a nationwide policy and is not taking place only in San Diego.

    It's up to the employer if he wants to keep you as an employee and has the right to cancel your H1 if he likes to do so. Just because you left the country doesnt mean that your H1 becomes invalid, but again its up to the employer.

    That's right. Only thing is he will be required to pay you. Make sure you get pay stubs in case you are asked to prove your status at re-entry.

    I opened 2 SR 's on my name and 2 on my wife's name, no use at all.I am a july 2nd filer transfered from NSC to CSC, still in CSC only,not transfered back to NSC.

    I had a question about using using AC21.

    Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
    If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?

    Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?


    Please advice!

    sir, if you have worked 180 days for this employer after filling of 485, there are no issues with CIS, atleast legally. However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy.     In case of an RFE for I140 premium processing, can the company respond via Fax or
    do they need to send the response via Fedex etc;


    For all Premium Processing cases, the service center first sends a fax to the number provided in the I-907 premium processing request form before mailing the hard copy of the RFE. So your lawyer/employer might have already received the fax...Check with them...

    IMHO, If you have a valid H1b visa, then you need to be gainfully employed to keep the visa valid and that would mean you continue to get paid. If not, then that that is a problem. Joining the 2nd company on EAD is not a problem. Coming back to the 1st company on EAD is not a problem either. If you want to keep your H!b alive/valid, then I would suggest that you port/transfer your H1b visa to the 2nd company and when you are done with him, transfer h1b back to 1st company.

    Seems like a lot of trouble to keep the h1b visa valid, but then again, that is one of the options.

    Thank you so much for your help. Really appreciate your help.

    So basically while I'm waiting for the priority date to become current, I can legally work aborad for several years without any harm to my GC application at all. When the priority date becomes current, I'll just need to come back to the U.S. to file I-485.

    Is that correct? Sorry for keeping asking. Just want to make sure before I make this major decision.

    I am working for Company A on a full time basis on H1B and part-time with Company B(non-profit) on a concurrent H1B. I filed for my GC with Company A and I-140 is approved and applied for I-485 and got EAD/AP also.

    My H1B with Company B is expiring and the 6 year term will end on December 31, 2009. I am planning to apply for H1B extension for this H1B and the company attorney says I can get it extended based on Company A I-140 because it is a concurrent H1B. How far is this true? Can I extend my Company B H1B based on the approval on Company A H1B?

    I appreciate your reply a lot.

    . My company people told me that they would be mailing the h1 transfer application on april 24. And hence i can join on April 28. So i joined and started working from them. i trusted my company and never asked for copy of receipt notice or case number. Few months later, i got H1b approval. Hence never thought there was any problem, until recently when i realized that Receipt Date on the H1b approval notice is May 15.

    This difference b/w my actual joining date i.e. April 28 and Receipt Date on H1b Notice i.e. May 15 is causing the concern

    Any advise in this regard is appreciated.

    Hi,
    My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
    H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
    RFE required me to provide Tax returns, company wage report and employment agreement.
    Can any one suggest what are my available options.
    How long I can stay in US?
    My lawyer is still waiting for the denial letter for more details.

    Dear Sir/Mam,

    I am presently working in India. My wife is getting an L1 visa approval petition. We need to go to the US consulate for visa stamping.

    My question is that 1) Do I need to resign from my current job to get a L2 visa stamping on my passport? 2) If not required, do I need to carry any form or letter from the company that I am on long leave/vacation to show it to the US consulate officier?

    Please advice.
