    I have never been to the meeting but will like to attend one if scheduled in future. i think its high time our Chapter schedule meeting with Senators/Congressmen in this area including MD, VA and DC. The President has started the immigration reform initiative and it is right time to make the lawmakers aware of our EB issues. Let me know your thoughts.

    About 1,000 highly skilled legal immigrants, carrying placards and cell phones and wearing T-shirts emblazoned with U.S. flags, rallied Tuesday at the Capitol to protest long delays and vast bureaucratic backlogs in the immigration system.

    The immigrants, including computer engineers, doctors and medical technicians from India and China, came from as far as California and Washington state to call on Congress to provide more permanent visas for highly educated immigrants and more resources for the overburdened immigration system. They said the plight of foreigners living in the United States legally had been eclipsed by the polarized debate over illegal

    immigration that led to the defeat of an immigration overhaul in June.
    The immigrants, who are living in the United States on student or high-skilled employment visas, said they were nearing despair with waits lasting as long as a decade to obtain visas giving them permanent residence, which are known as a green cards.

    I've not get EAD and AP and been waiting for last few months. My wife got both EAD and AP. Is it good idea to call USCIS I/O about my status of EAD and AP? I applied for all 485/EAD/AP in june last week and got the notice on Aug 15th. Please check my signature for more information.

    Please suggest me.

    If I've to call, what is the procedure? Please let me know.

    I agree ..I wonder what kind of effect will swine flu have ..it certainly gives the anti-immigrants a huge advantage (as predicted by pat buchanan) ...

    Will this bill contain a merit based sytem? I know Obama was the the key author of a bill based upon merit based in 2007.


    Has anyone of you come across any type of information which reflects on Merit based immigration system this year?

    I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.

    This is what politicians do, be it the US or India or any place on earth. BHO is one of them, isnt he? :cool:

    I also asked my company lawyer and they are suggesting that since her status is H4 she can not work. For working on EAD she has to leave country and reenter on AP.
    So a little confused here?

    That is not true. If she has her own EAD, she can start working anytime. Whenever she does that, she will automatically abandon H4 and her status will automatically become AOS.

    Hello IVians,

    I am with company A on L1B in the US. Company B is processing my GC for future employment. Now my L1B is up for renewal in December. There is a lot of paperwork that my company has asked me work on. In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.

    Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?

    Pls share your experiences.

    If new position is similar in responsibilities, then no effect. but if the responsibilities are changing, I would recommend talking to your immigration lawyer about it
    My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

    Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

    From the I-131 instructions document, find the list of docs required:

    - I131 application
    - copy of 485 receipt
    - Copy of Driver's license
    - Copy of I94
    - Copy of H1 - I797 Approval Notice
    - 2 Photos (A# and Name on back side with pencil)
    - Check ($305) to U.S. Department of Homeland Security

    - Send the application based on where you LIVE

    They have complete information.

    Your parents can get a passport extended here too.
    Check India consulate website about where you can mail the application where your parents are here

    Hello IVians,

    -- The truth.

    Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?

    -- if you lie and USCIS finds out then you are in big trouble. Also, existing applications can be looked up at any time (Eg: while adjudicating your 485 they can go over your old L1 application).
    Atleast the visa stamping form DS-156 asks if an immigrant visa petition has ever been filed for you, so its not uncommon, dont know about L1.

    Pls share your experiences.

    Hi all,

    I got my first H1B after my MS in Nov 2002 to Oct 2005. I have renewed my H1B for the next 3 year period (Nov 2005 to Oct 2008) and I have the necessary forms from the USCIS. Now I need to get my passport restamped. I am considering Tijuana, Mexico as I have a friend in San Diego that I want to see. However, my I94 form in my passport says it expires in Nov 2005. Now my question is:

    Can I go to Mexico for a restamp? What is the procedure/risk involved?

    Absolutely no problem. (assuming you visit is not very long - greater than six months and your GC gets approved as soon as you leave).

    You can return using your AP as some suggest. Be mindful not to show any non-immigrant visa ( H1, L1, B1 etc.) as that might be construed as abandoning LPR status. If you do not have a GC, some have been given deferred inspection (to prove your status in a local USCIS office at a later date). Another option is for someone to collect your GC and mail it with a reliable service abroad (FedEX etc.) - in anticipation of some disagreement, this is perfectly legal - it is not a passport and is a entry document not a departure doc.
