Dear Fellow Posters
After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?
Thanks in anticpation of your replies

Sorry if I am posting this in the wrong place, wasn't exactly sure where to post.
I applied for my Certifcate of Citizenship through my US citizen father about 5 years ago, and due to that US citizen father being an ass I still don't have it.
I have decided to just go back to England. I am happy about going back now and this post isn't about finding other ways of getting my citizenship.
When I originally came to the US I intended just to visit so I came on the Visa Waiver Program, and then decided to stay and become a citizen
My query is: When I leave to go back home will I be able to leave the US with just my passport(recently renewed) and ticket? or will I have to contact the USCIS and get some kind of letter or the like?
Thank You

Hi,
Im in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP As HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?
Tons of Thanks,
Ramkumar
No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

Canada has the world's largest oil reserves and the unnoticed scramble for control of the arctic area has been in the works for a while. The US had many opportunities to secure high skilled labor in the interest of economic prosperity, instead other countries such as Canada, Australia, Ireland, Germany etc had the foresight to realize the positive economic impact these workers have, the US didn't and the result is that its archaic immigration policies are beginning to demonstrate the consequences:
The Canadian government says the jurisdiction is clear they're Canadian waters. But the U.S. and some other countries don't agree. They see the Northwest Passage as an international strait that any ship should be free to transit.
http://www.cbc.ca/news/background/cdnmilitary/arctic.html
Even of greater significance was the recent claim by Russia to the entire North Pole:

Hello Attorneys/ known guys, ( first of all sorry for reposting new thread , i ddidnt get anyanswers but ead and ap expire time is coming soon )
How are you doing ? i am new to here. i will fill all details soon. sorry for that.
Before i stayed in place "X " which comes under nebrasaka centre, applied for 485, ead and ap. my company also in " X " only.
Right now i am in place " Y " which comes under Texas centre ( because of my job i moved recently) . Now i want to renew my ead and ap my self . my job, payroll and living is in place " Y " only.
But my pemanent address is " X " only. I want to continue that for my full GC process.
what my question is what i have to mention the address for my ead and ap renewal ?
1) is it "X " address as it is my permanent address and applied my 485 also from there and wish to continue or my "Y " address as i am working , living and payroll are here ?
2) If i mention " X " address is there any problem ? , dont think wrongly as i really dont know
3) if i put " Y " address is my case ead and ap along with 485 will move to Texas centre ?
i really want to avoid it if chances are there in good way as my case before everything in Nebrasca centre compared to Texas centre procesing time is good
4) If i put " Y " address i will get any RFE ?
I really dont want that as my 485 was applied from " X " place.
please answer . Thankyou in advance.

Thank you for taking up such a good cause!
I have one suggestion for the website.. Search engines are usually parameters-averse. For instance Google claims they may stop crawling if the links have too many parameters. The non-forum part of this Joomla powered website mostly utilize &s and ?s parameters in the URL.
The Joomla installation comes with an SEF component that converts &s and ?s into comma-separated directory structures.. You guys can turn it on in the admin panel. The conversion makes the URL look even uglier but it is at least SEF-compliant. Or there are other third party Joomla components that do a better job (though may require slightly more tuning)
Ed: Moved to new thread. Please start a new thread when you want start a new topic.

Send your petition to USCIS Ombudsman. This is a classic case of USCIS incompetence. They have all the documents and yet they pester you to provide the details.

I believe CGFNS is for foreign nationals who train outside the US. If you train here, I don't think you need it.
Well, when I talked to lawyer, even though he knew I have degree and Nclex from US, he asked me to get CGFNS visa screen.
Does this makes sense?
Thanks for you answer.

Hello All,
I am in a very sticky situation, my labor is pending @ PBEC with priority date of Jan'2004, which is Non-RIR and filed under EB3 category, based on which I have been getting incremental extensions of H1B (I am already in my 9th year by now). At present I am in the process of changing my filing type to RIR from TR and I was hoping to change the category too from EB3 to EB2, but my employers did not support me since they cannot pay the prevailing wage. I know I can still switch jobs, provided I transfer my H1B (which is valid till Jan2008) and the new company files my GC immediately, so my questions to fellow victims of PBEC is
How can I retain my old priority date?,
Does the job descriptions filed with old labor have to match with job descriptions filed in PERM?
It will be very tough, since I have almost 12+ yrs of exp in the industry, but my present employer is taking advantage of my situation and he is paying me peanuts, just because he does not want to pay me more, they have filed the papers as EB3. So while filing labor under EB2, can I still maintain my old priority date.
Please guys/gals help me out, I am not sure what to do, since I have already spent almost 3K$ on my GC and If I will be stuck with my employer at such low salary after my labor & I140 gets approved because of the retrogression it will be disaster. So I was thinking it would be better to be stuck with employer, who at least pays me decently and if I can retain my old dates it will awesome.
Regards,
CJG

Hi,
I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?
Thanks in Advance!!

Hello all,
My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?
Thank you in advance for any help.

Its anybodys guess....but u r one lucky guy to get ur receipt within 10 days...
Wow!
Not really. If you see the late June submitters thread, many of us who applied in the June 20th timeframe have got their receipts. It took us 5 weeks to get the receipts from the date of filing.

Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?
I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!
Prohibiting employees from paying the H1B application fees is not a new policy. It has always been there.
Refer violation 4.(i) in http://www.dol.gov/esa/forms/whd/WH-4.pdf
However there is a new policy prohibiting employees from paying Labor related expenses in GC process.

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?
Please reply ASAP.
L-1 petition is non-transferable and tied to employer A. However, employer B can file H-1 for you.

after you recieve the EAD card you have to apply for SSN at your local SSN office.the time period to recieve SSN is different in different states.i guess the minimum time is 15 business days. please correct me if I am wrong.
