Hello,
First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

Mine got approved in about 2 months time. My labor certificate reached the lawyer who passed it on to my employer.
I did a big mistake of not asking for a copy and again when I received it while filing I140 - did not make a copy again.
Please save a copy for yourself - it helps a lot while switching jobs during AC21.

I assume, you would have signed the labor before applying for I140.

Hello All,

My 7th year H1 expires on May 11 2007 and my company has already filed for my 3 year H1 extension based on my approved I-140 which will be valid from May 2007 to May 2010. My questions are the following:
1) Can I change my employer and keep my 2005 priority date if the new employer also agrees to file a fresh PERM app and I-140 for me?
2) If I qualify for EB2 category, can my new employer file for I-140 in EB2 category and still maintain the old priority date?
3) Since my current visa is valid till May 11 2007 and new visa will be valid from May 12 2007, can i start work for a new employer in April 2007 based on my new 3 year H1 or do I have to wait till May 2007 to start work on the new visa?
Any help will be greatly appreciaited.

Yes, what is this security clearance? I have applied for H1B renewal after 3 years on July 23rd (my receipt date) of 2007, and this still has not been processed and sent. I was told it has been sent for security clearance. I am here in US working without H1B visa after 7 months of my H1B visa expiry while my renewal is still pending as of today (03/07/08). Does anyone have an idea when is this going to be processed and will I ever get my work visa renewed ?

You cannot accept a scholarship
You cannot take an in-campus job
You cannot do an internship, apply for CPT or OPT's
If the above are all true.. there is no need to inform USCIS

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

I'm in the same boat...765 checks not cashed yet, rest got cashed on 9/20 and got the receipt numbers for 485/AP.

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

My passport will be expiring in next 6 months. I do have an appt pending with US embassy Bombay. I have some queries, if someone can please guide me:
1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?
Pls suggest.

Based on your approved I-140 if you are eligible to file 485 or get EAD then he can also get EAD.

My H1B Extn is pending at VSC since Nov 2008 and have same issue from day one. Looks like, some issues for some service centre applications via online.
