Hello All,
Brief History: I am working for a Food Processing company (A) in R&D. Company A was my sponsor for GC. I have been on EAD since Oct 2007 (filed 485 during July-Aug 2007 time period) :) . My I-140 was approved Jan 2007. My GC application was started in Apr 2006 - Perm process. Also, i still have my H1B(Extension) valid until Apr 2010. Company A uses a consulting firm for roughly about 25 - 35% of R&D projects.
Reason to change: I believe this opportunity will have a significant change/growth to my career.
Questions: :confused: Can i change my job to the consulting firm using EAD? What are the consequences i should expect from USCIS? Does the Consulting company have to get involved with any Immigration fillings?
If i decide to work for the consulting firm, i will still be doing the same job for Company A but as a consultant + I will have additional projects with other Food Processing companies. I think labor application job description won't change (Company A to Consulting Firm) and this is where i struggle to understand the rules. Need your thoughts and Advice.

You are correct that if you do not maintain valid H-1 status your wife will lose legal status in the US. If she pursues a degree as a FULL TIME student she can file for a COS to F-1. As part of that application she will have to document her valid H-4 status by proving that you are in valid H-1 status with current paystubs and/or letter confirming your employment from your H-1 employer. So it would be safest to file the COS while you are still employed.

"There is clear evidence to support the establishment of some form of bilateral agreement between the U.S. and Irish governments," Labour Minister Tony Killeen said in a statement after he returned from a trip to New York.
Killeen said that, while 30,000 to 40,000 illegal Irish immigrants were living in the United States, two centuries of mass emigration to the United States from Ireland because of famine and unemployment was clearly now at an end.
Ireland's Trade and Employment Ministry said more than 4,300 Americans immigrated to Ireland in search of employment in 2005, compared with 1,700 Irish people moving to the United States, where more than 10 percent of the population claims Irish descent.
Killeen said a jobs fair in New York showed how appealing Ireland had become in the wake of the "Celtic Tiger" boom.
"The interest expressed by Americans to come and work in Ireland was so great that a queue more than two-and-a-half blocks long formed outside the exhibition venue," he said.
"In less than 15 years, Ireland has gone from being the sick man of Europe to one of the most dynamic economies in the developed world."
Killeen told Reuters in New York last week that Ireland would also try to lure Irish and U.S. citizens back to Ireland where the population is now back above 4 million, having slumped to a 120-year low of 2.8 million in the 1960s.

Are you working now? Consult any immigration lawer on the steps to follow on the H1 transfer. I am not sure if there is a clause that you should have worked on the current company few months and get the pay checks. Also to transfer H1, you need copy of your 797 and not original. You can get it from your employer or from the lawer who filed H1. Bottom line, the forum answers should be taken as only guidence and not advice. Consult a IM lawer to confirm anything before you act.

I live in Chicagoland but my attorney is Ron Gotcher in CA (Calabassas/LA area), and I would recommend him very highly. The main thing I liked about him was that he is very reasonable and you can phone/email him as many times as you need to without getting charged left, right, and center.
I would recommend that you pick an attorney that is competent and charges a reasonable price, and one that you're comfortable with as opposed to where they're located.

Hi all,
My insurance company (Progressive) is charging a ridiculously high rate for liability only insurance for my H4 spouse who currently holds a valid permit. They say the rate will go further up when she gets a perm license after passing the road test.
I have heard this issue from other H1Bs who have different insurance carriers than mine.
Have you guys found a cheaper alternative? Insurance agents etc??

My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

as long as your gc is pending, you can get 1 year extension. After 140 approval and 485 still pending you can get 3 year extension. OR you can apply for EAD to continue in status.

DOL wont inform the candidate.
It is totally the companies call to let you know or keep you in dark about approval/denial.

You have to be "in-status" to apply for AOS. The IO wants evidence of your continued non-immigrant status before you filed your AOS. Also, remember AOS does not grant you a status. It just lets you not accrue unlawful presence

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.
Just my thought on this.

My wife is from Bangalore, however since Chennai did not have available dates till Jan 20th she has scheduled her H4 appointment at New Delhi for Jan 9th. Please share experiences.
